RENTAL AGREEMENT
Terms of Use/ Policies/ Disclaimer and Hold Harmless/ Contractual Agreement
When booking a property represented by Kelowna Waterfront Vacations Ltd., furthermore referred to as "Booking Agent", the following policies, responsibilities and disclaimers apply to each confirmed reservation.
Guest(s) Responsibilities
- Read thoroughly this Rental Agreement;
- Inspect the cottage upon check-in and report any pre-existing damage;
- Take care and respect the property;
- Immediately report any damage caused by Guest(s), a member of Guest(s)' party or any other party;
- Obey all rules, regulations and by-laws at The Cottages at Secret Point;
- Watch all children carefully at all times as the property, landscaping and terrain contain sources of potential danger including, but not limited to: many stairs, steep slopes, deep water, pressurized propane for barbeque, etc.;
- Exercise caution when going into the Lake as any water activity is Guest(s)' sole and absolute responsibility;
- Be responsible for cottage valuables during Guests(s)' stay by locking all doors whenever leaving, etc..
Booking Agent has a zero tolerance policy for any excessive noise, smoking, unauthorized pets and guests exceeding the maximum capacity. In the event that Booking Agent deems Guest(s) to have committed a policy, Strata rule or Strata bylaw violation, Booking Agent, its Agents and Owners reserve the right to evict Guest(s) and all occupants without notice and all pre-paid deposits and any other payments are considered earned and non-refundable.
Booking Agent caters to family and mature adult groups and the average age of the group must be over 25 years of age (except children). Failure to meet these pre-stated requirements is subject to eviction without notice and forfeiture of all payments made.
Rates
Rates are subject to change without notice. Rates of pre-booked stays cannot be changed.
Damage Deposit
Damage deposit - a minimum of $500 CAN - is required at the time of booking. Please note that this amount may increase depending on the property booked. Additionally, all policies, Strata rules and bylaw violations are subject to fines, which will be automatically deducted from damage deposit in case of violations.
Damage deposit may be charged the following: damage to the property, failing to meet guest stay requirements, failing to meet check-out time requirements, not meeting cleaning requirements, parking violations, BBQ damage, damage to boat slips and/or boat lifts, lost or damaged boat lift remotes or fobs, fines levied by the Strata Corporation.
Cancellation Policy
Any cancellations must be received in writing (letter, fax or email). Cancellations received more than 45 days prior to arrival will receive a full refund less a $50.00 administration charge. Reservation modifications made more than 45 days prior to arrival are subject to availability and a $50.00 administration charge, which is waived in the case of an upgrade to equal or greater value.
Cancellations received 45 days or less prior to arrival are subject to forfeiture of all monies paid. Reservation modifications made 45 days or less prior to arrival are subject to availability and a $50.00 administration charge. Modified reservations are non-refundable. Any reduction in length of stay will be considered a cancellation and subject to the cancellation policies contained herein.
If for reasons beyond Booking Agent's reasonable control, Booking Agent is unable to provide Guest(s) with accommodations as booked, Booking Agent reserves the right to cancel Guest(s)' stay
at any time. Guest(s) may then request an alternative holiday arrangement of comparable value, or
Booking Agent will refund all deposits.
In case of fire, sale of property, properties no longer in the rental pool or similar such events, Booking Agent reserves the right to transfer Guest(s) to an equivalent accommodation at its discretion, prior
notification may not be possible. If no other property is available, Booking Agent reserves the right to return all monies paid.
Currency
All rates, fees and payments are in Canadian Dollars. Please note that it is Guest(s)' responsibility to pay on-line transfer fees, bank wire fees and/or currency exchange fees.
Number of Guests
The maximum number of Guest(s) per cottage must not exceed 6 occupants (including children). No extra guests/visitors are permitted on the property at any time without Booking Agent's written
consent. Please note that any violations will result in eviction without notice and forfeiture of all payments made.
Pet Policy
Pets may be accepted at The Cottages at Secret Point at a special request. Written consent allowing each pet at the property must be obtained from Booking Agent.
- You are not allowed to bring to The Cottages any dog of the following breed, or cross-breed: Doberman Pincher, Rottweiler, Bull Mastiff, Pit Bull and any dog that is classified as being a vicious dog by any bylaws passed within municipalities of British Columbia;
- Pet owners must maintain reasonable control of and supervise their pet;
- Pet owners must ensure that their pet is leashed all times while on common property;
- Pet owners must immediately clean up all feces left by their pet;
- Pet owners must keep their pet from making unreasonable noise such as barking and whining.
A $250 fine will be deducted from damage deposit if there is a violation.
Keyless Entry
Guest(s) is provided with unique keyless entry code one week prior arrival provided their reservation is paid in full. Keyless entry code is changed regularly.
Check-In/Check-Out Time
Standard check-in time is 4:00 pm and standard check-out time is 10:00 am unless otherwise specified in writing by Booking Agent. Early check-in or late check-out may be possible, but is at the sole discretion of Booking Agent and must be requested by Guest(s) in advance.
Parking
Guest(s) is entitled to one parking spot in the main parking area, or if not available, in overflow parking. All additional cars, boat trailers and campers storage must be parked across Westside Road in overflow parking area. Violators will be towed at vehicle owner's expense.
Quite hours
Official quite hours are in effect from 11:00pm to 7:00am. Booking Agent and Property Owner(s) cater to families and mature adult groups and accordingly have a zero tolerance policy for any disturbance of the peace at The Cottages at Secret point at any time, including, but not limited to parties or excessive noise of any kind. Any violation will result in eviction without notice and forfeiture of all monies paid and.
Water advisory
Boil water advisory is currently in effect. Please boil water before drinking.
Washroom requirements
The Cottages at Secret Point are connected to a common Septic System. Guest(s) are not allowed to flush the following items down the toilet: paper towels, feminine hygiene products, newspaper and magazines, disposable diapers, sanitary napkins, fats or grease, cigarette butts, dental floss, metal items, etc. All of the above items can ruin the pumps and clog the tank and field.
Smoking
Smoking inside the cottage and on attached upper and lower decks is strictly prohibited. A $250.00 fine will be deducted from damage deposit if there is a violation. Smoking is only allowed on the main waterfront patio. Guest(s) must use caution when smoking and putting out their cigarette/cigar. Due to the nature of the material used to build The Cottage and extreme summer temperatures, even a tiny cigarette spark may start a forest/cottage fire.
Use of candles
Use of standard candles inside the cottage is strictly prohibited. A $250.00 fine will be deducted from damage deposit if there is a violation. Standard candles may be used on the main waterfront patio. Never leave burning candle unattended.
Use of BBQ
Guest(s) is welcome to use the BBQ located on the main waterfront patio, but not allowed to change location of the BBQ. Each time upon finishing cooking, Guest(s) must turn off the BBQ to avoid BBQ damage and fire hazard. During summer, Guest(s) is expected to always cover the BBQ if raining. During all other seasons, Guest(s) must cover the BBQ after each use. Before departure, Guest(s) is expected to thoroughly clean and cover BBQ.
Use of fire pit
Guest(s) must never leave fire unattended while using the fire pit. Due to extreme summer temperatures even a tiny spark may start a forest/cottage fire. If, due to hot weather, Okanagan Fire Ban is in effect, using of the fire pit is strictly prohibited. A $250.00 fine will be deducted from the damage deposit if there is a violation.
Water Activities
It is Guest(s)' sole and absolute responsibility to exercise caution when going into the Lake. Life jackets are provided free of charge and can be found in the main closet of the upper floor. Missing life jackets will be billed at $50.00 per jacket.
Buoy Limitation
Only the buoy in front of the cottage labeled with the cottage # may be used for boat moorage. Only boat less than 23 feet in length is permitted to be tied up at the buoy. Any larger boat exceeds the design limitation of the buoy and would cause a threat to person and property. Any violation will result in forfeiture of damage deposit.
Cleaning of property
Before departure Guest(s) is expected to do the following:
- Wash and put away all dishes, cutleries, frying pans, etc. and leave kitchen clean;
- Remove all items from refrigerator and thoroughly clean inside of refrigerator;
- Leave accommodations organized and tidy;
- Put all garbage in large garbage bags stored under the kitchen sink and leave them in the animal-proof garbage container on the left side of the cottage. Guest(s) need to make sure that the lid of each garbage container is closed tightly;
- Store and secure kayaks (if Guest(s) rented them);
- Thoroughly clean fire pit (if Guest(s) used it);
- Thoroughly clean and cover BBQ (if Guest(s) used it);
- Close waterfront patio umbrella;
- Turn off all lights and ceiling fans;
- Set all heat registers at 0C in the spring, summer or fall and at 12C in the winter;
- Lock all doors and windows.
Please be advised that should the property not be left in the above-mentioned condition, a deduction will be made against Guest(s) damage deposit at a rate of $35/hour PLUS additional
charge for unnecessary hit use.
Disclaimer and Hold Harmless
Kelowna Waterfront Vacations Ltd., its Agents and Owners shall not be held liable for, amongst other things, any damage, injuries, illness, weather related problems, acts of God, or any circumstances beyond their control occurring during or affecting Guest(s)' reservation or stay. Kelowna Waterfront Vacations Ltd., its Agents and Owners is not responsible for interruption of any services such as
phone, cable TV, internet, water supply, electricity supply, etc.
Please be advised that accommodations and common property The Cottages at Secret Point contain many stairs and not recommended to elderly people, people with disabilities and very young children.
Guest(s) hereby agrees to hold Kelowna Waterfront Vacations Ltd. harmless for all Strata actions outside our control, including but not limited to all inconveniences and construction work performed on
common and limited common strata property.
Kelowna Waterfront Vacations Ltd., its Agents and Owners act as an agent for property Owners and/or Property Managers and accepts no liability on their behalf under any circumstances. Kelowna Waterfront Vacations Ltd., its Agents and Owners is in no way liable for any act or omission of an Owner and/or Property Manager's description of the condition or state of any property.
Contractual Agreement
Confirmed reservations by way of email represent notice to all Guest(s) of all above terms and conditions including waiver of liability, cancellations and security agreement. By making a deposit and/or full payment for their reservation, Guest(s) is deemed to have read and agreed to the above- mentioned policies.
