RENTAL AGREEMENT

Terms of Use / Policies / Disclaimer

Renters Responsibilities

  1. Read thoroughly this Rental Agreement;
  2. Inspect the cottage upon check-in and report any pre-existing damage;
  3. Take care and respect the property;
  4. Immediately report any damage caused by you, a member of your party or any other party;
  5. Obey all rules and regulations at The Cottages;
  6. Watch all children carefully at all times as the property, landscaping and terrain contain sources of potential danger, including, but not limited to: many stairs, steep slopes, deep water, pressurized propane for barbeque, etc.;
  7. Exercise caution when going into the Lake as any water activity is your sole and absolute responsibility;
  8. Be responsible for cottage valuables during your stay by locking all doors whenever leaving.

Please note, in the event that we deem guest(s) to have committed a policy, Strata rule or Strata bylaw violation, we reserve the right to evict the guest(s) and all occupants without notice, and all pre-paid rents, deposits, and purchases shall be considered earned and therefore be retained by the property owner.

Rates
Price is subject to change without notice. Prices of pre-booked stays cannot be changed.

Damage Deposit

Damage Deposit in the amount $500.00 is required at the time of booking. Additionally, all Strata rules and bylaw violations are subject to fines levied by the Strata Corporation, which will be automatically deducted from the damage deposit in case of violations.

Cancellation Policy

Any cancellations must be received in writing (letter, fax or email). Cancellations received more than 45 days prior to arrival will receive a full refund less a $50.00 administration charge. Reservation modifications made more than 45 days prior to arrival are subject to availability and a $50.00 administration charge, which is waived in the case of an upgrade of equal or greater value.

Cancellations received 45 days or less prior to arrival are subject to forfeiture of all monies paid. Reservation modifications made 45 days or less prior to arrival are subject to availability and a $50.00 administration charge. Modified reservations are non-refundable. Any reduction in length of stay will be considered a cancellation and subject to the cancellation policies contained herein.

If for reasons beyond our reasonable control we are unable to provide your accommodations as booked and we notify you about that promptly, we reserve the right to cancel your stay at any time. You may then request an alternative holiday arrangement of comparable value, or we will refund your deposit.

Number of Guests

The maximum number of guests per cottage must not exceed 6 persons (including children). No extra guests/visitors are permitted on the property at any time without our written consent. Please note that any violations will result in eviction without notice and are subject to fines.

Pet Policy

Only small and medium size pets may be accepted at the cottage a special request. Written consent allowing pet at the property must be obtained from the owner.

  1. You are not allowed to bring to The Cottages any dog of the following breed, or cross-breed: Doberman Pincher, Rottweiler, Bull Mastiff, Pit Bull and any dog that is classified as being a vicious dog by any bylaws passed within municipalities of British Columbia;
  2. Pet owners must maintain reasonable control of and supervise their pet;
  3. Pet owners must ensure that their pet is leashed all times while on common property;
  4. Pet owners must immediately clean up all feces left by their pet;
  5. Pet owners must keep their pet from making unreasonable noise such as barking and whining.

A $250 fine will be deducted from the damage deposit if there is a violation.

Keyless Entry

Guests are provided with keyless entry code upon receiving full payment one week prior arrival. Keyless entry code is changed regularly.

Check-In/Check-Out Time

Check-in time is 4:00 pm. Check-out time is 10:00 am sharp please.

Late check-out time may be requested (subject to availability). If late check-out is required, please inquire at least 3 days prior to your departure.

Parking

You are entitled to one parking spot in the main parking area, or if not available, in our overflow parking. All additional cars, boat trailers and campers storage must be parked across Westside Road in our overflow parking area. Violators will be towed at vehicle owner’s expense.

Quite hours

Official quite hours are in effect from 11:00pm to 7:00am. We cater to families and mature adult groups and accordingly have a zero tolerance policy for any disturbance of the peace at The Cottages at any time, including, but not limited to parties or excessive noise of any kind. Any violation will result in forfeiture of damage deposit.

Water advisory

Boil water advisory is currently in effect. Please boil your water before drinking.

Washroom requirements

We are connected to a common Septic System. Please do not flush the following items down the toilet: paper towels, feminine hygiene products, newspaper and magazines, disposable diapers, sanitary napkins, fats or grease, cigarette butts, dental floss, metal items, etc. All of the above items can ruin the pumps and clog the tank and field.

Smoking

Smoking inside the cottage is strictly prohibited. A $250.00 fine will be deducted from the damage deposit if there is a violation. Smoking is only allowed on the main waterfront patio. Please use caution while smoking and especially putting out your cigarette/cigar. Due to extreme summer temperatures and nature of the material used to build our cottage, even tiny cigarette spark may start a forest fire.

Use of candles

Use of standard candles inside the cottage is strictly prohibited. A $250.00 fine will be deducted from the damage deposit if there is a violation. Standard candles may be used on main waterfront patio. Never leave burning candle unattended. Please note that we provide battery-operated candles at our cottage, so please do not try to light them with a lighter or matches J

Use of BBQ

You are welcome to use the BBQ located on the main waterfront patio. Please do not change location of the BBQ. Each time you finish cooking your meal, make sure you turn the BBQ off to avoid BBQ damage and fire hazard. During summer, please always cover the BBQ if raining. During all other seasons, please cover the BBQ after each use. Before departure, you are expected to thoroughly clean and cover BBQ.

Use of fire pit

Please never leave fire unattended while using the fire pit. Due to extreme summer temperatures even tiny spark may start a forest fire. If, due to hot weather, Okanagan Fire Ban is in effect, using of fire pit is strictly prohibited. A $250.00 fine will be deducted from the damage deposit if there is a violation.

Water Activities

It is your sole and absolute responsibility to exercise caution when going into the Lake. Life jackets are provided free of charge and can be found in the main closet of the upper floor. Missing life jackets will be billed at $50.00 per jacket.

Buoy Limitation

Only the buoy in front of the cottage labeled with the cottage # may be used for boat moorage. Only boat less than 23 feet in length is permitted to be tied up at the buoy. Any larger boat exceeds the design limitation of the buoy and would cause a threat to person and property. Any violation will result in forfeiture of damage deposit.

Cleaning of property

Before departure you are expected to do the following:

  1. Wash and put away all dishes, cutleries, frying pans, etc. and leave kitchen clean;
  2. Remove all items from refrigerator and thoroughly clean inside of refrigerator;
  3. Leave accommodations organized and tidy;
  4. Put all garbage in large garbage bags stored under the kitchen sink and leave them in the animal-proof garbage container on the left side of the cottage. Please make sure that the lid of each garbage container is closed tightly;
  5. Store and secure kayaks (if you rented them);
  6. Thoroughly clean fire pit (if you used it);
  7. Thoroughly clean and cover BBQ (if you used it);
  8. Close waterfront patio umbrella;
  9. Turn off all lights and ceiling fans;
  10. Set all hit registers at 0C in the spring, summer or fall and at 10C in the winter;
  11. Lock all doors and windows.
    Please be advised that should the cottage not be left in the above-mentioned condition, a deduction will be made against your damage deposit at a rate of $25/hour along with additional charge for unnecessary hit use.

Disclaimer and Hold Harmless

Kelowna Waterfront Vacations Ltd., its Agents and Owners shall not be held liable for, amongst other things, any damage, injuries, illness, acts of God, or any circumstances whatsoever occurring during or affecting a guest’s reservation or stay. Please be advised that our accommodations contain many stairs and not recommended to elderly people, people with disabilities and very young children. Guests hereby agree to hold Kelowna Waterfront Vacations Ltd. harmless for all strata actions outside our control, including but not limited to all inconveniences and construction work performed on common and limited common strata property.

Contractual Agreement

Confirmed reservations by way of email represent notice to all guests of all above terms and conditions including waiver of liability, cancellations and security agreement. Guests are deemed to have read and agreed to the above-mentioned policies.
